Healthy Homes Compliance Statement: What Auckland Landlords Need to Know

Call 020 4013 7848

If you are signing a new or renewed tenancy agreement for an Auckland rental, it needs to include a healthy homes compliance statement. It is a short document with a big job: a signed record of where your property currently stands against the five Healthy Homes Standards.

This guide explains what the statement is, when you need it, which records to keep and how a healthy homes assessment in Auckland makes it easier to complete with confidence.

Quick answer: New or renewed tenancy agreements must include a signed statement with details of the property’s current level of compliance with the Healthy Homes Standards. Leaving it out can mean a financial penalty of up to $500 per tenancy, and you must keep records that show how you comply. A written healthy homes assessment is a practical way to back the statement up.

What is a healthy homes compliance statement?

A healthy homes compliance statement is a signed statement, included in the tenancy agreement, that sets out the property’s current level of compliance with the Healthy Homes Standards. Landlords have had to include one since 1 December 2020.

Tenancy Services provides a template, and using it is the easiest way to make sure you cover everything. You can find it from the Tenancy Services healthy homes compliance page.

When do you need one?

Every new or renewed tenancy agreement needs a signed statement. That includes the tenancy you are about to start with a new tenant and any renewal for a tenant who is staying.

Since 1 July 2025, all private rentals have had to meet the standards, so the statement should now describe a property that complies. If your checks show it doesn’t, fix the gaps before you sign a new agreement rather than recording problems you already know about.

What the statement covers

The statement records the property’s current level of compliance with each of the five standards:

  • Heating: a suitable fixed heater in the main living room.
  • Insulation: ceiling and underfloor insulation that meets the standard.
  • Ventilation: openable windows in liveable rooms and extractor fans in kitchens and bathrooms.
  • Moisture ingress and drainage: working drainage, gutters and downpipes, and a ground moisture barrier where there is an enclosed subfloor.
  • Draught stopping: no unreasonable gaps or holes causing noticeable draughts.

Not sure how to answer one of them? Work through our healthy homes standards checklist, which shows what passes and what fails for each standard.

How a healthy homes assessment helps

The law doesn’t require you to use a professional assessor. But signing a statement about five separate standards is easier when someone has checked each one and written it down.

A healthy homes assessment gives you a clear answer for every standard and flags anything that needs attention. You then know exactly what to put in the statement, and you have a report to keep with your tenancy records. At Ace Energy, an assessment is $150 including GST. If you want to read more about what to expect, see our landlord’s guide to healthy homes assessments in Auckland.

Records to keep

Landlords must keep all records and documents that show how they comply with the standards, and make them available on request. If a tenant asks for information about compliance, you must provide it within 21 days.

Good records include:

  • Your healthy homes assessment report.
  • Installer invoices and receipts for insulation, heating, fans and drainage work.
  • Before-and-after photos of any work.
  • Product details, such as insulation R-values and heater capacity labels.
  • Copies of each signed compliance statement.

Keep everything for each property together in one folder, on paper or on your computer, so you can find it quickly when someone asks.

What if you leave the statement out?

Landlords who don’t include the statement when it is required could face a financial penalty of up to $500 for each tenancy, or other enforcement action. More broadly, landlords who don’t meet their healthy homes obligations are in breach of the Residential Tenancies Act 1986 and may face financial penalties of up to $7,200.

Some properties are exempt from some or all of the standards in specific situations. Check the exemptions before assuming one applies to you.

Before you sign: a simple routine

  1. Check each standard. Use our checklist to see where the property stands.
  2. Fix any gaps. We install insulation, heat pumps and ground moisture barriers, and can help with ventilation.
  3. Get a written report. Book a healthy homes assessment in Auckland for proof of where the property stands.
  4. Complete and sign the statement. Use the Tenancy Services template and make sure it matches your report.
  5. File your records. Add the statement to the tenancy agreement and keep the report, receipts and photos together.
